ABSTRACT:

The most debatable article of constitution of India should be article 21, which states “No person shall be deprived from his personal life and liberty except procedure established by law”. It is available to both citizen and non-citizen of India. It has been a roller coaster ride for this particular fundamental right from the very first day of its creation till latest vendetta over AADHAAR issue. It is now one hot topic to talk about that Right to privacy is a integral part of Indian constitution or it has no value. The Lok sabha’s recently passed finance bill made AADHAAR mandatory for filing tax returns and getting a Permanent account number (PAN). In fact government of India wants AADHAAR is a mandatory document to avail such services, but apex judiciary decided to re-look the queries cum controversy that AADHAAR card scheme is an invasion into person’s right to privacy. Here in this research paper the authors mainly focused on the verdict and outcome of the case related to constitutional validity of AADHAAR and its clashes with right to privacy. “Yes, you are under surveillance. Yes, it is odious. Yes, it should bother you. And yes, it's hard to know how to avoid it.”
