Abstract

The separation of children from adult offenders was one of the main justifications for theestablishment of juvenile justice systems, as was the parent‟s patria principle, which maintains that thestate is responsible for all children who require protection and care. Juvenile courts were established as aunique system from the traditional criminal justice system, with its own set of processes and tactics forrehabilitating and rehabilitating young adults who had committed crimes. Differential treatment for youngoffenders entered its fourth stage of growth with the growing recognition of children's human rights, asreflected by the United Nations Convention on the Rights of the Child. The researcher examines thenational and international implications of differentiating punishment for juvenile criminals.
